Terms of use
Gotcha app and gotcha-tcg.com website · Last updated: 18 October 2026
This is a translation for convenience. The French version is the reference text and prevails in case of any difference.
By creating an account or using Gotcha, you accept these terms. If you don’t agree, please don’t use the app.
1. The service
Gotcha is a free app that lets trading card collectors report and check restocks in stores and online, manage their collection, and offer trades to other members nearby. Gotcha is published by Juan Casas (see the legal notice, in French).
2. Your account
- You provide accurate information, including your date of birth.
- If you are under 15, you need a parent’s permission. Between a minor and an adult, messages are limited to preset replies.
- Your account is personal. You are responsible for what is done with it, and you keep your password to yourself.
- You can delete your account at any time (how to do it, in French).
3. Community rules: zero tolerance
Gotcha accepts no offensive content and no abusive behaviour. In a username, photo, message, report or listing, you may not post, send or offer:
- hateful, discriminatory, violent, sexual or pornographic content, or any content sexualising a minor;
- harassment, threats, insults, intimidation, or disclosure of someone else’s personal information;
- scams, attempted fraud, counterfeits, or fake cards presented as genuine;
- false restock reports, spam or unsolicited advertising;
- proposals to meet anywhere other than a public place, or any solicitation of a minor;
- any illegal content or content infringing the rights of others.
4. Reporting, blocking and moderation
- You can block a member and report a member, a message or a photo from the app, at any time.
- Reports are reviewed within 24 hours. Content that breaks these rules is removed, and its author may be warned, suspended or permanently banned.
- A restock reporter who is often contradicted by the community sees their reliability drop and may be restricted.
- You can also write to [email protected].
5. Trades, sales and meet-ups between members
Gotcha only connects people. The app helps two members interested in a trade or a sale find each other and talk. Everything that follows happens directly between them: Gotcha is not a seller, buyer or intermediary, is not a party to the trade or sale, takes no payment, and is not present at meet-ups.
- Meet-ups. Choosing the place, time and conditions of a meeting is your decision alone and your responsibility. Gotcha is not responsible for anything that may happen during or after a meet-up between members: the other person’s behaviour, lateness or no-show, disputes, loss, theft, damage, accidents or any other incident. If you are in danger or witness an offence, contact the authorities first (112 in Europe), then report the member in the app.
- Authenticity of cards and products. Gotcha does not check and cannot guarantee the authenticity, originality, condition, conformity or value of the cards, sealed products or other items offered by members. A card recognised by the scanner or shown in a binder is not an authenticated card. It is up to you to check what you receive before you agree to a deal.
- Counterfeits and fake cards. Offering a counterfeit or fake card as genuine is forbidden (section 3). If a member does so, Gotcha may remove their listings, suspend them or permanently ban them from the platform. These are the only measures Gotcha can take: Gotcha does not refund, compensate, or recover the cards or money involved. You remain free to file a police report or take action against the other member.
- Disputes between members are settled directly between them. At the request of the authorities, Gotcha may share the information required by law.
- Our safety tips: only meet in a shop or a busy public place, preferably during the day; tell someone close to you; if you are a minor, come with an adult; examine the cards (in good light, out of the sleeve if needed) before trading; never pay in advance someone you haven’t met.
- After a trade, each member can leave an honest review of the other.
6. Restock reports
Alerts are posted by the community and by monitoring public sources. They are for information only: Gotcha does not guarantee the availability or price of a product in store or online.
7. What you post
You remain the owner of your photos and texts. You allow Gotcha to display them in the app, to the members concerned, for as long as the service requires. You guarantee that you have the right to post them.
8. Intellectual property
Gotcha is an independent project, not affiliated with, endorsed or sponsored by The Pokémon Company, Nintendo, Creatures or GAME FREAK. Product and store names belong to their owners and are mentioned only to identify items. Gotcha’s name, design and illustrations (including avatars) may not be reused without permission.
9. Liability
Gotcha is provided as is. We do our best to keep it running, but it may be interrupted, in particular for maintenance.
For listings, messages and photos posted by members, Gotcha acts as a hosting provider: we do not review their content in advance, but we promptly remove anything reported to us as unlawful.
Gotcha is not responsible for trades, sales and meet-ups between members or their consequences, for the authenticity or condition of the items traded (section 5), or for decisions made on the basis of a restock alert (section 6).
Nothing in these terms excludes the liability the law imposes on Gotcha for its own fault, or the rights you have under the law.
10. Changes and governing law
These terms may change; if there is a significant change, you will be informed in the app. They are governed by French law. In case of a dispute, please contact us first at [email protected] to find an amicable solution.
Your personal data is processed as described in the privacy policy (in French).
